Be The Story: Exercising My Voting Rights

Timothy Pena • Oct 30, 2022

So I voted today. The first time in many years. It’s a strange feeling. I wanted to leave and come back on actual voting day just to get the sticker that says, ‘I voted today.’ I’ll have to save that for two years from now when I might have been eligible to vote in Arizona, my home state. My home state that stays silent as a Commissioner from Ohio with a brother in prison and a record of discrimination to openly use that derogatory language from the bench to one of their veteran sons.

People born and raised in Arizona shouldn’t have to subjected to abuse from those who have no consideration for our upbringing, values, or morals. They see any history and then see that as an opportunity to score easy points. There are courts which feel it is in their interest to inflict harsher penalties only because we are in our home state and their access to years of records is easier, although still incorrect. That incorrect information is then hidden from us while 40 years of infractions are thrown in our face as if they were all committed yesterday. We are told our behavior will not be tolerated. I was constantly reminded I have a history of “this exact same thing.” But, yet had to make adjustments to other cases from 2002 to bring in under the seven year threshold for repetitive. This was in 2018 when my last ‘anything’ was in 2002. Sixteen fucking years and it’s still the exact same behavior? What the fuck does that even mean?

It is no less derogatory nor discriminatory to tell someone, “Being a veteran is not a ‘get out of jail free card’ as it would be to use that in the context of “being a Jew” or “being black” or “being gay” as a ‘get out of jail free’ card. I can’t go back 40 years to when I became a veteran, and neither should the courts be able to go back 40 years to justify the use of derogatory and discriminatory for being a veteran. My attorney, Rebecca Felmly, stood by and said nothing in court, but wanted me to know that whatever abuses I was suffering were some of the worst she’s ever seen.

There are Democrats in Arizona who are bitching about the state’s getting control of abortion rights but have never lifted a finger about state’s infringing on national voting rights. The fact that most of those that would vote in national elections would also vote blue is overwhelming. You would think taking up state’s rights would be to their advantage as well as their collective argument, yet crickets. As a former Republican, the reason why is they would have to become inclusive of everyone, and not something they are willing to concede. That’s what I learned after 45 years as a McCain Republican. Dems have always been, “our way or no way.”

While advocating for all inclusivity, Democrats of Arizona will shut you down by shutting off their phones. A sympathetic and ignorant media takes note and follows suit. In my case, during one of my PTSD moments and after months of voicemail over an LGBTQ+ and Army Mortuary Specialist veteran, I dared called the democratic candidate for county attorney a c*nt. Her reaction was exactly as a prosecutor. That behavior will not be tolerated. I was blocked from social media, phone, and email. The same woman who vowed to “serve those who have served us” was pulling the plug on her love of veterans, John Legend be damned! I hardly remembered sending her a couple of texts in the middle of a mental breakdown. The sober PTSD moments are not much different than those when I’ve abused alcohol. It wasn’t until I read her email blaming me for her mental health while making no acknowledgment that I too, suffer mental illness. At least I admit to mine. I don’t come off as a superhero who then destroys those people she couldn’t save.

I still voted blue today. So sick of the Republicans with this stolen election crap. Until everyone of them is rounded up and out of office will I have any faith in the party I grew up with. I sacrificed a lot as Veterans Affairs is about to shortly find out. Arizona Democrats are pathetic in as the only person they showed up for was a Brittney Griner campaign fundraiser where everyone who ‘purchased’ a free ticket was also included to receive unsolicited campaign fundraising emails.

It should be of comfort to Democrats and Republicans both. In a few short days the election will be over, then three days later, Veterans Day. Within a span of three days, we can be remembered, thanked for our service, exploited for campaign dollars, and then completely forgotten all before the weekend.

Soon after arriving, Tim decided he would rather be homeless in NYC than commit suicide in Phoenix and spent five months in a shelter before obtaining his HUD/VASH voucher for supportive housing while detailing his journey from homeless to homeness with a series of articles called, 'Be the Story'.
